Terms of Use

Welcome to the Canadian Institute for Health Information (“AV”) website (the “Website”). AV provides products and services (the “AV Services”) to you as either a registered client or a visitor. AV provides access to and use of the Website and the AV Services on the following conditions.

Use of the Website and AV Services is subject to these conditions; please read them carefully. By accessing and using the Website, AV Services and AV Materials (as defined below), you are agreeing to be bound by the terms and conditions of use set out below (“Online Terms of Use”). If you cannot or do not wish to be bound by these Terms of Use, you may not use the Website, AV Services or AV Materials.

In addition to these Terms of Use, some AV Services are subject to additional specific terms, and you agree to access and use the AV Services in accordance with these specific terms, as applicable (the “Service Terms”). In the event of any inconsistency between these Terms of Use and the Service Terms, the Service Terms will prevail.

AV may modify or change these Terms of Use and the Service Terms, in whole or in part, at any time and without notice. Please ensure that you review these Terms of Use and Service Terms regularly to ensure you remain in compliance. If any part of any term is held to be invalid or otherwise unenforceable, the affected part of the term will be deemed severed and the remainder of the terms will continue in full force and effect.

Acceptable use

In accessing and using the Website, AV Services and AV Materials, you may not

  • Interfere with the proper functioning of the Website or the AV Services in any way
  • Knowingly transmit, send or upload any material that contains viruses, worms, spyware, adware, Trojan horses or similar computer code that could adversely affect the operation of the Website or its users
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, in association with your use of AV Services and/or AV Materials
  • Share your account or your Means of Access (as defined below) with others 
  • Access or attempt to access the accounts or the Means of Access of other users 
  • Compromise or attempt to compromise security measures implemented within the Website, AV Services or AV Materials
  • Take any action that imposes an unreasonable or disproportionately large load on the Website
  • Take any action involving the Website that will have the effect of facilitating unsolicited bulk email
  • Recalculate, reverse engineer or otherwise attempt to reproduce or assist others to reproduce any part of the Website, AV Services or AV Materials, unless otherwise permitted in writing by AV.

Ownership and licensed rights

AV is the owner of the Website, AV Services and the reports, information and other works included in or made available through these (collectively the “AV Materials”). However, parts of the Website, AV Services and AV Materials may contain specifications or other intellectual property licensed to AV or owned by other organizations, such as the World Health Organization and interRAI. 

In addition to the protection afforded by these Terms of Use and any Service Terms, the Website, AV Services and AV Materials are protected nationally and internationally under intellectual property laws.

Your use of the Website, AV Services and AV Materials does not grant you any ownership rights to these and you may not do anything more with the Website, AV Services and AV Materials than as expressly permitted under these Terms of Use and Service Terms.

Use of AV Materials

You may freely use and reproduce AV Materials for the purposes of education, non-commercial research, internal reference and private study. You are not permitted, however, to make any commercial use of AV Materials without AV’s express prior written authorization. Additionally, you may not incorporate AV Materials into commercial textbooks or into software applications of any kind without AV’s express prior written authorization, nor may you use AV Materials in any way that could reasonably be seen as competing with AV. You may not interfere with anyone else’s access to or use of AV Materials, sell AV Materials, or substitute or attempt to substitute modified AV Materials for the originals on the Website. If you want to use and reproduce AV Materials for purposes other than as set out above, including commercial use and use in textbooks, please email copyright@cihi.ca.

You must credit AV as the source of any AV Materials you use or reproduce in a document or other work that will or may be distributed to others. If those AV Materials contain elements AV licensed from its licensors, you must likewise credit those licensors. Additionally, you must not remove or conceal any copyright notice or acknowledgement placed by AV or its licensors when using or reproducing AV Materials.

AV’s client services system and applications

Some of AV’s Services, such as eStore, Vendor Licensed Product portal and eReporting applications (“Restricted AV Services”), are restricted to specific AV clients, such as ministries of health and health facilities, as well as to some commercial clients, all of which must meet eligibility requirements.

Clients must set up an account and have a username and password (“Means of Access”) prior to accessing the Restricted AV Services. The Means of Access are considered confidential information and 

  • May not be disclosed to any person or entity for any reason
  • Are non-transferable
  • Cannot be issued to an un-named individual or occupational position. 

In addition to requiring an account, these Restricted AV Services are governed by Service Terms, and you must agree to these terms before being granted access. You are responsible for all activities done under your account and agree to notify AV immediately of any actual or potential unauthorized use of your account, including your Means of Access.

If you already have Means of Access, you can . If you wish to access the Restricted AV Services but do not have an account, please email help@cihi.ca to see whether you meet the eligibility requirements and to set up your account.

Modifications to the Website and AV Services

AV reserves the right to make changes to the Website and to the AV Services by adding or discontinuing one or more web pages, AV Services or AV Materials. Unless otherwise set out in the Service Terms, changes to restricted AV Services will be communicated to all affected registered clients.

Electronic communications

By using the Website or sending communications from any device to us, you are communicating with us electronically. You consent to AV sending you commercial electronic messages, as that term is defined in An Act to Promote the Efficiency and Adaptability of the Canadian Economy by Regulating Certain Activities that Discourage Reliance on Electronic Means of Carrying out Commercial Activities, and to Amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act, SC 2010, c 23, as modified from time to time. You may withdraw this consent at any time by clicking the Unsubscribe link at the bottom of AV communications or by emailing help@cihi.ca.

Disclaimer of warranties — LIMITATION OF LIABILITY

AV PROVIDES THE WEBSITE, AV SERVICES AND ALL AV MATERIALS “AS IS” AND “AS AVAILABLE” AND MAKES NO, AND DISCLAIMS ALL, REPRESENTATIONS, WARRANTIES, CONDITIONS OR PROMISES OF ANY KIND WITH RESPECT TO THE WEBSITE, AV SERVICES AND AV MATERIALS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING AS TO NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, UNINTERRUPTED OR ERROR- FREE SERVICE, OR THE AVAILABILITY, ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY OR VERACITY OF THE AV SERVICES OR AV MATERIALS. THE ENTIRE RISK AS TO THE USE OF THE AV WEBSITE, AV SERVICES AND AV MATERIALS IS ASSUMED BY YOU.

Applicable law

These Terms of Use, together with any Service Terms, are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to principles of conflicts of law.
